These Terms of Service (“Terms”) govern your use of the QuantLapse mobile application (“App”), operated by QuantDays (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13.
2. Description of Service
QuantLapse is a timelapse creation and metrics tracking application that allows you to:
- Capture or upload photos to create timelapses
- Track custom metrics (e.g., weight, calories, distance) associated with your photos
- Generate timelapse videos from your photos
- Export data as CSV files
- Optionally sync data across devices via encrypted cloud storage
The App is available in a free tier with limited features and a premium subscription tier (“QuantDays Pro”) with expanded capabilities.
3. User Accounts
Account Creation
You may use the App without creating an account. If you choose to create an account, you may sign in using email/password, Apple Sign-In, or Google Sign-In. You are responsible for maintaining the confidentiality of your account credentials.
Account Security
You are responsible for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.
4. Subscriptions and Payments
Free and Premium Tiers
The free tier allows one active timelapse with one metric per timelapse. QuantDays Pro unlocks unlimited timelapses, unlimited metrics, cloud sync, and watermark removal from generated videos.
Billing
Premium subscriptions are available as monthly, annual, or lifetime purchases. Payments are processed through the Apple App Store or Google Play Store. By subscribing, you agree to the pricing and payment terms presented at the time of purchase.
Auto-Renewal
Monthly and annual subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription through your App Store or Google Play account settings.
Refunds
Refunds are handled according to the policies of the Apple App Store or Google Play Store. We do not process refunds directly.
Restore Purchases
You may restore previously purchased subscriptions on a new device by using the restore purchases feature within the App.
5. User Content
Ownership
You retain all ownership rights to photos, videos, metric data, and any other content you create or upload through the App (“User Content”). We do not claim ownership of your User Content.
License to Us
By using cloud sync features, you grant us a limited, non-exclusive license to store and transmit your User Content solely for the purpose of providing the sync service. Your User Content is encrypted before transmission and storage; we cannot access the unencrypted content.
Responsibility
You are solely responsible for your User Content. You represent that you have all necessary rights to any content you upload or capture using the App.
6. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse engineer, decompile, or disassemble the App
- Interfere with or disrupt the App’s servers or infrastructure
- Circumvent any access restrictions, subscription requirements, or security features
- Use the App to store or transmit content that infringes on the rights of others
- Use automated systems or bots to access the App
7. Intellectual Property
The App, including its design, code, logos, and branding, is owned by QuantDays and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, trade names, or logos. The “QuantLapse” name and logo are proprietary to QuantDays.
8. Third-Party Services
The App integrates with the following third-party services:
- Apple and Google for authentication
- Supabase for account authentication and encrypted data storage
- Cloudflare for encrypted photo storage
- RevenueCat for subscription and purchase management
Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of third-party services.
9. Data and Privacy
Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the App, you consent to the practices described in the Privacy Policy.
10. Disclaimer of Warranties
The App is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure, or that any defects will be corrected.
11. Limitation of Liability
To the maximum extent permitted by applicable law, QuantDays shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of user content, arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.
Our total liability for any claims arising from or related to these Terms or your use of the App shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless QuantDays, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the App, your violation of these Terms, or your violation of any rights of a third party.
13. Termination
We may suspend or terminate your access to the App at any time, with or without cause, with or without notice. Upon termination, your right to use the App ceases immediately. Data stored locally on your device remains accessible to you. If you have an active subscription, cancellation of your account does not entitle you to a refund for any unused portion of your subscription.
You may delete your account at any time. Upon account deletion, your cloud-synced data will be permanently removed from our servers.
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms within the App or by other reasonable means. Your continued use of the App after the effective date of the revised Terms constitutes your acceptance of the changes.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction.
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
17. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and QuantDays regarding the use of the App and supersede all prior agreements and understandings.
